DraftKings Faces Class Action Over AI Model Accused of Targeting Likely Losers

A federal class action claims DraftKings used a machine-learning “elasticity score” to decide which customers received promotions. DraftKings denies the allegations.

What the lawsuit claims

According to the complaint, the model sorted customers by how much a promotion was likely to change their betting. Gamblers judged “inelastic”, meaning bonuses were unlikely to increase their activity, received fewer incentives.

The suit cites a former employee who told The New York Times that the system was designed to work out whether a customer would give the company more money than it handed out in incentives, and that the approach was then to “open the floodgates”.

The privacy angle

The plaintiff’s lawyers argue this use of customer data conflicts with DraftKings’ own privacy notices. Those notices say personal information may be used to identify potentially problematic play and to provide responsible-gambling resources.

The suit asks for damages, refunds, disgorgement of money allegedly obtained through the model, and an injunction stopping DraftKings from using it to encourage customers to keep gambling.

Why it matters

These are allegations, not findings, and DraftKings denies them. Still, the case puts a sharp question to the industry: if operators can predict who will keep betting, should that same data be used to protect players rather than to market to them? Regulators and courts are likely to watch the outcome closely.
